Terms of Use

This is the agreement between you and Gallerio Swipe Clean. By downloading or using the app you accept it.

1. The agreement

Gallerio Swipe Clean (the "app") is published by Ali Gürkan Sevilmiş ("we", "us"). These Terms of Use ("Terms") govern your use of the app. If you do not accept them, do not use the app.

2. Who may use Gallerio

You must be at least 13 years old. In countries where the age of consent for data processing is higher, you must be at least that age. By using the app you confirm you meet this requirement.

3. Your licence

We grant you a personal, non-transferable, non-exclusive, revocable licence to use the app on devices that you own or control, as permitted by the App Store Terms of Service. You may not copy, sell, rent, sublicense, reverse-engineer or attempt to derive the source code of the app, except where that restriction is prohibited by law.

4. Your account

An anonymous account is created for you when you first open the app, and it gives you the whole app. You may connect it to Apple or Google so that your profile survives losing your device; that is optional. You are responsible for keeping access to whichever account you connect. You can delete your Gallerio account at any time from Profile → Settings → Delete account.

5. Your content

Your photos are yours and stay on your device. We claim no ownership of them, and we never receive them.

The only content you can send us is your profile photo and the profile fields you fill in. For those, and only for as long as you keep them, you grant us a limited, worldwide, royalty-free licence to store and display them back to you inside the app. The licence ends when you delete the content or your account.

You are responsible for what you put into your profile. Do not use a photo you do not have the right to use.

6. Rules of use

You agree not to:

• use the app to break the law or to infringe anyone's intellectual property or privacy;
• put content into your profile that you have no right to use, or that impersonates another person;
• attempt to break, overload, probe or reverse-engineer the app or our servers, or use them through automated means.

7. What you export

Images you make with Photo Templates, Gallery Wrapped and Story Templates are yours to keep, post and share anywhere. Each one carries a small gallerio wordmark inside its frame, never over your photo. That mark is part of the app and may not be removed, cropped out or obscured in anything you publish. There is no paid option to remove it.

8. Gallerio Plus

Gallerio is free to download and use. Some template packs and story formats are part of an optional paid subscription, Gallerio Plus, offered as a monthly plan, a yearly plan with a 7-day free trial, and a one-time Lifetime purchase. Prices are shown in the app in your local currency before you buy and are set through the App Store.

The monthly and yearly plans are auto-renewable subscriptions. Payment is charged to your Apple Account at confirmation of purchase. A subscription renews automatically for the same period and price unless you turn off auto-renew at least 24 hours before the current period ends. Your account is charged for renewal within 24 hours before the period ends. If you start the yearly free trial, any unused portion of the trial is forfeited when you buy a subscription. You can manage or cancel your subscription, and turn off auto-renew, in your Apple Account settings after purchase. The Lifetime option is a single payment that does not renew.

Purchases are handled entirely by Apple; Gallerio never sees or stores your payment details. Refunds are requested through Apple, not through us.

9. Availability and changes

We may change, suspend or discontinue any part of the app at any time. We will not intentionally break your ability to export or delete your own data.

10. Termination

You may stop using Gallerio at any time and delete your account from inside the app. We may suspend or terminate your access if you break these Terms. Sections 5, 7, 10, 11 and 12 survive termination.

11. Disclaimer

The app is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, or that it will meet your requirements.

Gallerio is not a backup service. Keep your own copies of anything you care about. Deleting a photo goes through your device's operating system and is subject to the system's own behaviour, and once iOS has permanently removed a photo we cannot recover it.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for lost data or lost profits, arising from your use of the app. Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.

13. Governing law

These Terms are governed by the laws of the European Union and, where applicable, the Federal Republic of Germany, where the service is hosted. If you are a consumer, you keep the protection of the mandatory consumer law of the country where you live, and you may bring proceedings in the courts of that country.

14. Apple

These Terms are between you and us. Apple is not a party to them and is not responsible for the app or its content. The App Store Terms of Service also apply to your installation. In addition:

• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation.
• Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability, failure to conform to legal requirements, and consumer protection or privacy claims.
• If a third party claims the app infringes their intellectual property, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
• You confirm you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
